This site is owned and operated by East of Eden 17 Ltd trading as East of Eden, registered in England at Studio 1, 14 Hatherley Mews, London E17 4QP as company number 09581563.
These terms and conditions include general terms and conditions for use of this Site, and relating to the services provided by East of Eden in our studios.
These Terms and Conditions are incorporated into the Registration Form and any Membership or Class whether in person or online is subject to these Terms and Conditions as amended from time to time.
East of Eden 17 Limited reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of the Studios and/or the conduct of Members. Any such changes will be published on the Website and, until revoked, are binding on Members.
Please read these terms and conditions carefully. Your use of this Site, the purchase of any Products or Services on this Site or in a studio will be subject to these terms and conditions. By using the site and visiting the studio, you hereby agree to our terms and conditions.
Terms and Conditions - General
Classes are always subject to availability but at East of Eden we will always do our best to accommodate you in your chosen class.
All classes must be prepaid by the purchase of class credits or unlimited memberships and all clients agree to our 12hr notice policy when cancelling and/or rescheduling IN STUDIO classes (no notice policy for our ONLINE classes). So if you’re booked into a class, but miss it or cancel with less than 12 hours notice (in studio only), you will be charged the credits for it unless agreed otherwise with a member of staff. Unlimited Members will be fined £15 for late cancels and no shows as detailed below.
Bookings are made through the Bsport software which can be accessed at https://eastofeden.uk/full-timetable.
In studio class size is limited and East of Eden 17 Limited operates a “first come first served” booking policy. Online booking takes priority over people who drop in.
An in studio booking can only be claimed by attending at reception and advising the receptionist you are present.
For an online class booking via BSport, you can find your find your zoom link on your BSport dashboard. To access your BSport account/dashboard and book a class, please go here - https://backoffice.bsport.io/login?membership=308 - and click forgot password if you don't have your login details. You can also access this via the My Account button on the main menu on our website. Please login, look at My Next Sessions then under the session is a green button saying ACCESS LIVE. If you are accessing the class via the BSport App, the ACCESS LIVE button will disappear when the class has started, however you can access the class after this point if you are running late via the web browser - https://backoffice.bsport.io/login?membership=308.
On Demand links will be sent out after the class has finished and you have 48 hours from when we send the link to view. We are not responsible for any classes missed as a result of not being able to login correctly..
Any Unlimited Member (pre-paid or rolling) who regularly books online and fails to show up for class without cancelling may be blocked from booking online and their unlimited membership revoked.
Unlimited Member Cancellation Policy for IN STUDIO classes (this does not apply to credit bundle holders who forfeit their credits if they late cancel or do not show up) – 2 late cancellations per month (starting from the date your subscription fee is debited) – no penalty
– Any additional late cancellations and ALL NO SHOWS will incur a charge of £15. This must be paid the next time you go to the studio following the date the fine was incurred. The penalties are recorded separately for late cancels and no shows, so will kick in separately.
– Any cancellations need to be made prior to the 12 hour cancellation window. If you let us know you cannot make your class and we can fill your spot, we can early cancel you out of class.
– We regret to inform you that we cannot admit latecomers to any class for health and safety reasons and to avoid disruption to the class and other customers. Please arrive early to avoid disappointment.
Guest passes are available on the Unlimited ‘All Studio’ membership only. You are entitled to one guest pass a month and this must be booked through us (give us a call or email to book).
Rolling memberships will be active from the date the first payment is taken. If we attempt to take a payment and it fails, we will pause your membership until payment is made. After 6 months, you can cancel at any time however we require 14 days notice before the month end (date depends when you started the membership), in order to be sure you won’t be charged for the subsequent month.
Classes start promptly at the advertised times. Members arriving at reception once the instructor has started class will not be allowed to attend that class.
All lost and left property is disposed of within 14 days.
For security reasons Members are advised to place all their valuables in lockers provided. Belongings are left at the Member’s own risk.
East of Eden is a shoe free zone in the studios (except RIDE). All outdoor footwear is to be removed and placed in the shoe areas provided.
For safety reasons and because all Members are barefoot – No crockery, glass or anything breakable is permitted in any part of the Studios
Customers must bring a suitable hot yoga towel to all hot classes, big enough to cover the mat. These can be rented or purchased from us too.
No food is to be consumed within the studios themselves.
Members should not walk around the Studios barefoot if they have verrucas or similar foot complaints.
Members are required to use a suitable towel for the purpose of covering their yoga mat in the studio.
In the event of a fire, Members are asked to make their way to the nearest available exit.
Teachers will physically adjust and sometimes use oils and lotions as part of a massage. If you do not wish to be adjusted or massaged, please take a consent card from reception and leave it visible on your mat.
Classes are for students age 18+. If you are younger, please do ask if we can accommodate you before booking into class. Babies can be brought to parent and baby classes only, and we run regular kids and toddler classes but unfortunately we cannot accommodate children in our regular classes.
Health
Members with low/high blood pressure and/or cardiac irregularities should not attend class until they have written permission from their doctor. If there is any doubt, the Member should consult his doctor. Members must notify the Studio of any circumstances affecting their health, which may be exacerbated through continued use of the Studio.
If you are pregnant, we have 5 pre-natal classes per week, which are safe to attend whether or not you have exercised pre pregnancy. If you would like to continue with your usual classes, please just double check before attending the studio that the teacher is qualified and insured to teach pre-natal students. Please always arrive early enough to advise the teacher and ask for modifications before class starts (10 mins before start time.) Please also be aware that some teachers may not be happy teaching pregnant members and we do leave this decision up to the individual teacher, hence asking you to check first. We do not recommend starting anything new in pregnancy. If the teacher agrees to the Member participating in class, this is at the Member’s own risk.
Important Liability Statement
The information available on or through this Site, and the Services supplied via or in connection with this Site or East of Eden 17 Limited do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor. You also warrant that you have not experienced any COVID-19 symptoms before coming to the studio. If you experience COVID-19 symptoms after leaving the studio, you will inform us immediately so that we can inform all customers you were in a class with as per Government regulations.
In consideration of East of Eden accepting a person as a Member, the Member agrees that:
Neither East of Eden 17 Limited, nor its partners, instructors and employees are responsible for any injuries suffered by the member caused whole or in part by the Member’s failure to faithfully follow the instructions of the instructor or by any physical impairment or injury not fully disclosed to the Studios in writing.
It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this web site (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by us to you.
Neither East of Eden 17 Limited, nor its partners, instructors and employees are responsible for loss or damage to a Member’s personal belongings.
East of Eden 17 Limited reserves the right to change the class schedule, including cancellation of individual classes and change of instructor without notice
You, your legal representatives and your heirs release waive, discharge and covenant, not to sue East of Eden 17 Limited and its instructors for any injury or death caused by their negligence or other acts.
Warranties
East of Eden 17 Limited warrants that the Products and Services will be supplied with reasonable skill and care.
Credits are sold on a pay as you go single class basis, in credit bundles of different denominations and as unlimited memberships, or such other combinations as East of Eden 17 Limited may introduce from time to time. The Client Shall not transfer sessions to any other person or permit them to be used by anyone other than the Client. Any assignment, transfer or disposal of courses is at the sole discretion of East of Eden 17 Ltd and may only be permitted in exceptional circumstances. Class credit fees are non refundable.
Class credit fees may be increased by East of Eden 17 Limited at any time.
Details of class times at the Studio may vary from time to time. Classes will be published by the Studio and will be available at the Studio or on our Website(s).
Any booked sessions must be cancelled within 12 hours, in person or online. In any other case, the session will be charged and the credit deducted from the remainder of the Client’s course.
When you are purchasing a class you are paying for a class and not an instructor. Instructors are subject to change without notice.
The rights of cancellation and refund and any limitation expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to Products or Services may only be credited to the credit or debit card originally used to make the purchase.
All credits expire within 6 months of purchase if not used.
The Introductory 30 day trial starts from the date the first class is taken.
The pay upfront Memberships start from the date of purchase and expires at the end of the Membership duration.
The rolling Membership starts from the day of purchase and continues until the Member gives 14 days written notice of their intention to stop it, not to be within the first 6 months. Payment will be made monthly by card payment using the card stored on file. You can pause your rolling membership for 1 month within a 12 month period by emailing info@edeneast.co.uk with at least 2 weeks notice, not to be in the first 6 months. Pre-paid memberships can not be paused except if you have a health problem that prevents you from practising, in which case we would need to see a doctor’s note.
Definitions
In these terms and conditions, the following definitions apply: “Services” means any information and services ordered and/or provided by East of Eden 17 Limited through or via the Site or our studios and all services offered as part of any course or workshop. Any electronic information supplied to you by East of Eden 17 Limited will constitute part of “Service” not a Product and cancellation rights will apply accordingly. “Products” means any products offered for sale on the Site or in a East of Eden 17 Limited studio. “Site” means the web site at the URL www.edeneast.co.uk or replacement site(s) from time to time. “Member” means anybody who takes a class at East of Eden.
Site Usage and Intellectual Property Rights
You may use the Site for personal and lawful use and in accordance with these terms and you are not allowed to copy or use any material from the Site for any commercial purpose.
The intellectual property rights in all contents of the Site and supplied as part of the Products or Services, and in the East of Eden 17 Limited trade marks and logos (“Materials”) are owned by East of Eden 17 Limited. Except to the extent expressly set out in these terms and conditions, you are not allowed to make any copies of any part of any Materials, or remove or change anything on the Site, include or create links to or from the Site without our written authority, or remove or change any copyright, trade mark or other intellectual property right notices contained in any Materials or copies thereof. You must not use the East of Eden brand, logos or marks without written licence.
Your Personal Information
Usage of your personal information is governed by the East of Eden 17 Limited privacy policy, which forms part of these Terms and Conditions.
Liability
You are referred to the important liability statement at the top of these terms and conditions. Subject to that statement you agree that your use of this Site and the Service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, East of Eden 17 Limited does not enter into conditions, warranties or other terms in relation to the Site or the Products or the Services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.
The Site may include links to external sites and co-branded pages. East of Eden 17 Limited has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting, However, East of Eden 17 Limited is not responsible for the content of these site and pages or for anything provided by them.
Subject to the important liability statement East of Eden 17 Limited is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you.
Suspension and termination of Service
East of Eden 17 Limited may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or any Sites or pages linked to it will be not necessarily be uninterrupted or error free.
East of Eden 17 Limited may terminate the Service immediately in the event you breach any of these terms and conditions or do not pay any sums due to East of Eden 17 Limited (including if the credit/debit card you use is not valid or does not work for another reason).
Pricing
Information displayed on the Site or in our studio as to pricing and availability is subject to change by East of Eden 17 Limited without notice.
General
East of Eden 17 Limited may change these terms and conditions from time to time. By browsing the Site you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.
These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
